This document and the other documents that we reference below make up our house rules, or what we officially call our Terms of Use. The Terms are a legally binding contract between you and Mahjool LLC. This contract sets out your rights and responsibilities when you use Mahjool.com, our mobile apps, and the services provided by Mahjool (we’ll refer to Mahjool.com, our mobile apps and other services as our “Services”), so please read it carefully. By using any of our Services (even just browsing of our websites), you’re agreeing to the Terms. If you don’t agree with the Terms, you may not use our Services. If you agree, please read on!

Mahjool's Services connect people around the world, both online and offline, to make, sell and buy unique goods. Here’s a handy guide to help you understand the specific rules that are relevant for you, depending on how you use the Services:

All of these policies are a part of our Terms, so be sure to read the ones that are relevant for you. Of course, you'll still want to read the rest of this document because it applies to everyone!

We know your personal information is important to you, so it’s important to us. Our Privacy Policy details how your information is used when you use our Services, and it’s also a part of our Terms, so please read it here.

4. Your Account with Mahjool

Top

You’ll need to create an account with Mahjool to use some of our Services. Here are a few rules about accounts with Mahjool:

  1. You must be 18 or older to use our Services. Otherwise, you may only use our Services under the supervision of a parent or legal guardian.
  2. Be honest with us. Provide accurate information about yourself. It’s not OK to use false information or impersonate another person or company through your account.
  3. Choose a nice username. A username that is offensive, vulgar, or infringes someone’s intellectual property rights violates the Terms.
  4. You are responsible for your account. You’re solely responsible for any activity on your account. If you’re sharing an account with other people, then the person whose billing information is on the account will ultimately be responsible for all activity. If you’re registering as a maker, you personally guarantee that you have the authority to agree to the Terms on behalf of the business. Also, your accounts are not transferable.
  5. Protect your password. As we mentioned above, you’re solely responsible for any activity on your account, so it’s important to keep your account password secure.
  6. Let's be clear about our relationship. These Terms don't create any agency, partnership, joint venture, employment or franchisee relationship between you and Mahjool.

5. Your Content

Content that you post using our Services is your content (so let’s refer to it as “Your Content”). We don’t make any claim to it. That includes anything you post using our Services (like usernames, shop names, profile pictures, listing photos, listing descriptions, reviews, comments, videos, etc.).

  1. Responsibility for Your Content. You understand that you are solely responsible for Your Content. You represent that you have all necessary rights to Your Content and that you’re not infringing or violating any third party’s rights by posting it.
  2. Permission to Use Your Content. By posting Your Content through our Services, you grant Mahjool a license to use it. We don’t claim any ownership to Your Content, but we have your permission to use it to help Mahjool function and grow. That way, we won’t infringe any rights you have in Your Content and we can help promote your stuff.
  3. Rights You Grant Mahjool. (Here’s the legalese version of the last section). By posting Your Content, you grant Mahjool a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of Your Content to provide the Services and to promote Mahjool, your Mahjool shop, or the Services in general, in any formats and through any channels, including across any Mahjool Services or third-party website or advertising medium.

    That sounds like a lot, but it's necessary for us to keep Mahjool going. Consider these examples: if you upload a photo of a listing on your Mahjool shop, first, we have permission to display it to buyers, and second, we can resize it so it looks good to a buyer using our mobile app; if you post a description in English, we can translate it into French so a buyer in Paris can learn the story behind your item; and if you post a beautiful photo of your latest handmade product, we can feature it on our homepage, in one of our blogs or even on a billboard to help promote your business and Mahjool's.

  4. Reporting Unauthorized Content. Mahjool has great respect for intellectual property rights, and is committed to following appropriate legal procedures to remove infringing content from the Services. If content that you own or have rights to has been posted to the Services without your permission and you want it removed, please follow the steps listed in our Intellectual Property Policy. If Your Content infringes another person’s intellectual property, we will remove it if we receive proper notice. We’ll notify you if that happens.
  5. Inappropriate, False or Misleading Content. This should be common sense, but there are certain types of content we don’t want posted on Mahjool’s Services (for legal reasons or otherwise). You agree that you will not post any content that is abusive, threatening, defamatory, obscene, vulgar or otherwise offensive or in violation of our Prohibited Items Policy, Community Policy or any part of our Terms. You also agree not to post any content that is false and misleading or uses the Services in a manner that is fraudulent or deceptive.

6. Your Use of Our Services

License to Use Our Services. We grant you a limited, non-exclusive, non-transferable and revocable license to use our Services—subject to the Terms and the following restrictions in particular:

  1. Don’t Use Our Services to Break the Law. You agree that you will not violate any laws in connection with your use of the Services. This includes any local, state, federal and international laws that may apply to you. For example, it’s your responsibility to obtain any permits or licenses that your shop requires; you may not sell anything that violates any laws; and don’t commit fraud, theft or any other crimes against Mahjool, another Mahjool user or a third party.
  2. Pay Your Bills. You are responsible for paying all fees that you owe to Mahjool. You are also solely responsible for collecting and/or paying any applicable taxes for any purchases or sales you make through our Services.
  3. Don’t Steal Our Stuff. You agree not to “crawl,” “scrape,” or “spider” any page of the Services or to reverse engineer or attempt to obtain the source code of the Services. If you want to use our API, please follow our API Terms of Use.
  4. Don’t Try to Harm Our Systems. You agree not to interfere with or try to disrupt our Services, for example by distributing a virus or other harmful computer code.
  5. Follow Our Trademark Policy. The names "Mahjool" and "Mahjool Consulting Service," and the other Mahjool marks, phrases, logos and designs that we use in connection with our Services, are trademarks, service marks or trade dress of Mahjool in the U.S. and other countries. If you’d like to use our trademarks, please contact info@mahjool.com.
  6. Share Your Ideas. We love your suggestions and ideas! They can help us improve your experience and our Services. Any unsolicited ideas or other materials you submit to Mahjool (not including Your Content or items you sell through our Services) are considered non-confidential and non-proprietary to you. You grant us a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use and publish those ideas and materials for any purpose, without compensation to you.
  7. Talk to Us Online. Mahjool will provide you with certain legal information in writing. By using our Services, you’re agreeing to our Electronic Communications Policy, which describes how we provide that information to you. It says that we can send you information electronically (by email, etc.) instead of mailing you paper copies (it’s better for the environment), and that your electronic agreement is the same as your signature on paper.

7. Termination

  1. Termination By You. We hate to see you go, but you may terminate your account with Mahjool at any time from your account settings. Terminating your account will not affect the availability of some of Your Content that you posted through the Services prior to termination. Oh, and you’ll still have to pay any outstanding bills.
  2. Termination By Mahjool. We may terminate or suspend your account (and any related accounts) and your access to the Services at any time, for any reason, and without advance notice. If we do so, it’s important to understand that you don’t have a contractual or legal right to continue to use our Services, for example, to sell or buy on our websites or mobile apps. Mahjool may refuse service to anyone, at any time, for any reason.

    If you or Mahjool terminate your account, you may lose any information associated with your account, including Your Content.

  3. We May Discontinue the Services. Mahjool reserves the right to change, suspend or discontinue any of the Services at any time, for any reason. We will not be liable to you for the effect that any changes to the Services may have on you, including your income or your ability to generate revenue through the Services.
  4. Survival. The Terms will remain in effect even after your access to the Service is terminated, or your use of the Service ends.

8. Warranties and Limitation of Liability (or the Things You Can’t Sue Us For)

  1. Items You Purchase. You understand that Mahjool does not manufacture, store or inspect any of the items sold through our Services. We provide the venue; the items in our marketplaces are produced, listed and sold directly by independent sellers, so Mahjool cannot and does not make any warranties about their quality, safety or even their legality. Any legal claim related to an item you purchase must be brought directly against the seller of the item. You release Mahjool from any claims related to items sold through our Services, including for defective items, misrepresentations by sellers or items that caused physical injury (like product liability claims).
  2. Content You Access. You may come across materials that you find offensive or inappropriate while using our Services. We make no representations concerning any content posted by users through the Services. Mahjool is not responsible for the accuracy, copyright compliance, legality or decency of content posted by users that you accessed through the Services. You release us from all liability relating to that content.
  3. People You Interact With. You can use the Services to interact with other individuals, either online or in person. However, you understand that we do not screen users of our Services, and you release us from all liability relating to your interactions with other users. Please be careful and exercise caution and good judgment in all interactions with others, especially if you are meeting someone in person. This Help article has some good advice about handling in person meetings.
  4. Third-Party Services. Our Services may contain links to third-party websites or services that we don’t own or control (for example, links to Facebook, Twitter, and Instagram). You may also need to use a third party’s product or service in order to use some of our Services (like a compatible mobile device to use our mobile apps). When you access these third-party services, you do so at your own risk. The third parties may require you to accept their own terms of use. Mahjool is not a party to those agreements; they are solely between you and the third party.
  5. Warranties. Mahjool is dedicated to making our Services the best they can be, but we’re not perfect and sometimes things can go wrong. You understand that our Services are provided “as is” and without any kind of warranty (express or implied). We are expressly disclaiming any warranties of title, non-infringement, merchantability and fitness for a particular purpose, as well as any warranties implied by a course of performance, course of dealing or usage of trade.

    We do not guarantee that: (i) the Services will be secure or available at any particular time or location; (ii) any defects or errors will be corrected; (iii) the Services will be free of viruses or other harmful materials; or (iv) the results of using the Services will meet your expectations. You use the Services solely at your own risk. Some jurisdictions do not allow limitations on implied warranties, so the above limitations may not apply to you.

  6. Liability Limits. To the fullest extent permitted by law, neither Mahjool, nor our employees or directors shall be liable to you for any lost profits or revenues, or for any consequential, incidental, indirect, special or punitive damages arising out of or in connection with the Services or these Terms. In no event shall Mahjool’s aggregate liability for any damages exceed the greater of one hundred ($100) US Dollars or the amount you paid Mahjool in the past twelve months. Some jurisdictions do not allow limitations on incidental or consequential damages, so the above limitations may not apply to you.

9. Indemnification (or What Happens If You Get Us Sued)

We hope this never happens, but if Mahjool gets sued because of something that you did, you agree to defend and indemnify us. That means you’ll defend Mahjool (including any of our employees) and hold us harmless from any legal claim or demand (including reasonable attorney’s fees) that arises from your actions, your use (or misuse) of our Services, your breach of the Terms or your account’s infringement of someone else’s rights.

We reserve the right to handle our legal defense however we see fit, even if you are indemnifying us, in which case you agree to cooperate with us so we can execute our strategy.

10. Disputes with Other Users

If you find yourself in a dispute with another user of Mahjool’s Services or a third party, we encourage you to contact the other party and try to resolve the dispute amicably.

  1. Case System. Buyers and sellers who are unable to resolve a dispute related to a transaction on our websites or mobile apps may participate in our Case System. You can find details about the Case System in this Help article. Mahjool will attempt to help you resolve disputes in good faith and based solely on our interpretation of our policies, in our sole discretion; we will not make judgments regarding legal issues or claims. Mahjool has no obligation to resolve any disputes.

  2. Content You Access. You may come across materials that you find offensive or inappropriate while using our Services. We make no representations concerning any content posted by users through the Services. Mahjool is not responsible for the accuracy, copyright compliance, legality or decency of content posted by users that you accessed through the Services. You release us from all liability relating to that content.
  3. Release of Mahjool. You release Mahjool from any claims, demands and damages arising out of disputes with other users or parties.

11. Disputes with Mahjool

If you’re upset with us, let us know, and hopefully we can resolve your issue. But if we can’t, then these rules will govern any legal dispute involving our Services:

  1. Governing Law. The Terms are governed by the laws of the State of Massachusetts, without regard to its conflict of laws rules, and the laws of the United States of America. These laws will apply no matter where in the world you live.
  2. Arbitration. You and Mahjool agree that any dispute or claim arising from or relating to the Terms shall be finally settled by arbitration, using the English language, administered by the American Arbitration Association (the “AAA”) under its Commercial Arbitration Rules then in effect (those rules are deemed to be incorporated by reference into this section). Our arbitration will be handled by a sole arbitrator in accordance with those rules. Judgment on the arbitration award may be entered in any court that has jurisdiction. Any arbitration under the Terms will take place on an individual basis: class arbitrations and class actions are not permitted. You understand that by agreeing to the Terms, you and Mahjool are each waiving the right to trial by jury or to participate in a class action. Notwithstanding the foregoing, each party shall have the right to bring an action in a court of proper jurisdiction for injunctive or other equitable or conservatory relief, pending a final decision by the arbitrator.
  3. Forum. We’re based in Norwood, Massachusetts, so any legal action against Mahjool related to our Services must be filed and take place in Norwood. That means the seat of any arbitration shall be Norwood. For any actions not subject to arbitration, you and Mahjool agree to submit to the personal jurisdiction of a state court located in Kings County, Massachusetts or the United States District Court for the Eastern District of New York.

If you are a government agent or entity in the United States using the Services in your official capacity, and you are legally unable to agree to the clauses in this section, then those clauses do not apply to you. In that case, the Terms and any action related to the Terms will be governed by the laws of the United States (without reference to conflict of laws) and, in the absence of federal law and to the extent permitted under federal law, the laws of the State of Massachusetts.

12. Changes to the Terms

We may update these Terms from time to time. If we believe that the changes are material, we’ll definitely let you know by doing one (or more) of the following: (1) posting the changes through the Services or (2) sending you an email or message about the changes. That way you can decide whether you want to continue using the Services. Changes will be effective upon the posting of the changes. You are responsible for reviewing and becoming familiar with any changes. Your use of the Services following the changes constitutes your acceptance of the updated Terms.

13. Some Finer Legal Points

The Terms, including all of the policies that make up the Terms, supersede any other agreement between you and Mahjool regarding the Services. If any part of the Terms is found to be unenforceable, that part will be limited to the minimum extent necessary so that the Terms will otherwise remain in full force and effect. Our failure to enforce any part of the Terms is not a waiver of our right to later enforce that or any other part of the Terms. We may assign any of our rights and obligations under the Terms.

Privacy Policy

At Mahjool, we care deeply about privacy. We believe in transparency, and we’re committed to being upfront about our privacy practices, including how we treat your personal information. We know you care about your privacy too, so we provide settings that allow you to choose how certain information is used by Mahjool. This policy explains our privacy practices for Mahjool.com (we’ll refer to Mahjool.com as the "Site"), Mahjool’s mobile applications (the "Apps") and services provided by Mahjool, Inc ("Mahjool").

This policy is a part of our Terms of Use. By visiting the Site or using the Apps, you consent to our collection, transfer, manipulation, storage, disclosure and other uses of your information as described in this policy. This includes any information you choose to provide that is deemed sensitive under applicable law. This policy only applies to Mahjool’s Site, Apps and services. We are not responsible for the content or the privacy policies of any of our members, websites hosted by the Site through our Pattern by Mahjool tool, third-party websites, or apps. Mahjool’s Terms of Use require all account owners to be at least 18 years of age (or have the permission and supervision of a responsible parent or legal guardian), therefore, this policy does not discuss use of our Site, our Apps, or services by minors.

Export of Data

By using Mahjool, you authorize Mahjool to use your information in the United States and any other country where Mahjool operates. Please be aware that the privacy laws and standards in certain countries, including the rights of authorities to access your personal information, may differ from those applying in the country in which you reside. We will only transfer personal data to these countries where permitted to do so by law and we will take steps to ensure that your personal information continues to enjoy appropriate protections.

To use our platform, you will need to provide us with a valid email address and you may be able to choose a username. Depending on the services you choose, we may collect additional information, for example: information in private channels like Conversations, billing or payment information, a telephone number, and a physical address. Please note that for security and performance reasons, such content may need to be accessed by certain Mahjool personnel from time to time.

Your username is publicly displayed and connected to your activity on the Site and the Apps. Other people may see the date you joined; ratings, reviews and related photos for items you purchased or sold; your profile information; items you listed for sale; your shop pages and policies; your favorites, followers and those you follow; sold item listings and the number of items sold; and comments you post in our community spaces. You may optionally choose to provide and publicly display your full name and other personal information (such as birthday, gender, and location).

You may connect to the Site or the Apps with an external application, in which case Mahjool may receive information from that other service, as explained below.

We use technologies such as cookies, clear gifs, log files, and flash cookies for several purposes, including to help understand how you interact with our site and services, in order to provide a better experience. For more information about cookies, see our Cookies & Tracking Technologies page.

Uses and Sharing

We use the information that we gather from you users in a number of ways. For example, if you purchase an item, we’ll share your shipping information with the seller; we could use your forum suggestions to improve our services; we use data analytics and work with certain third-party service providers for targeted online and offline marketing; and of course, we use your email address to communicate with you. We also partner with service providers and other third parties that collect, use, promote, and analyze information about Mahjool and visitors.

Mahjool will not sell or disclose your personal information to third parties without your consent, except as specified in our Privacy Policy.

Choices

You may review and change your information in your account settings, and you may remove certain optional pieces of information.

You may control the receipt of certain types of communications from Mahjool in your account settings. And although Mahjool does not currently respond to “do not track” browser headers, you may opt out of online behavioral ads through this link: http://www.aboutads.info/choices/. You also may limit certain tracking by disabling cookies in your web browser. For more information about managing cookies, see our Cookies & Tracking Technologies page.

Information Collected or Received

As a Mahjool or Mahjool Consulting member you are required to provide a valid email address at registration and you may be able to choose a username or alias that represents your identity on the Site and the Apps.

Depending on which services you choose to use, Mahjool may require additional information to provide the service, such as a shop name, billing and payment information (including billing address, telephone number, credit card information), a telephone number, and/or a physical postal address. As a Mahjool seller, if you choose to use our direct checkout payment service ("Direct Checkout"), Mahjool may require information such as your social security number, identification ID or tax ID, date of birth, bank account information, credit card information and/or other proof of identification in order to verify your identity and provide this service to you and to comply with applicable law. We may store credit card information and use it for both billing and payment purposes. Mahjool may contact individual shop owners to confidentially request more information about their shops or items listed on the Site, or to ensure compliance with our rules and applicable law. Certain products or services on Mahjool may require you to complete an application; information you submit through the application processes will not be displayed publicly and will only be used internally by Mahjool, unless otherwise specified.

You may optionally choose to provide and publicly display your full name and other personal information (such as birthday, gender, location) in connection with your account and activity. If you do not want this additional information displayed publicly, you can remove it through your Mahjool Public Profile page.

Your username, user ID or alias is publicly displayed and connected to your activity on the Site and the Apps. Other people may see the date you joined, reviews, ratings, profile information, items listed for sale, shop pages, sold item listings, and comments in community spaces.

Mahjool automatically receives and records information from your browser or your mobile device when you visit the Site or use the Apps, such as your IP address or unique device identifier, cookies and data about which pages you visit on the Site or on the Apps and stores it in log files. We may combine this automatically collected information with other information we collect about you. This information helps us to prevent fraud and keep the Site and Apps secure, analyze and understand how the Site and the Apps work for members and visitors, and provide a more personalized experience for members and visitors. For more information about online tracking tools (including flash cookies) and how we use them, see our Cookies & Tracking Technologies page or “Information Uses, Sharing & Disclosure” section below. When you use the Apps, you may choose to share your geo-location details with Mahjool in order to use our location-based services. If you have provided your location details but would no longer like to share that information, you may opt out of those services through the settings on the Apps or on your mobile device. We will only share your geo-location details with third parties (like our mapping providers) for the sole purpose of providing you with those services. You may also enable the Apps to access your mobile device’s camera to upload photographs to Mahjool.

Some members or visitors may connect to the Site or the Apps or register an account using an external third-party application, such as Facebook, Gmail or LinkedIn. Mahjool may receive data from those connected third-party applications. Connecting your Mahjool account to third-party applications or services is optional, and when you connect your account to an external app, you will be granting Mahjool permission to receive information from the third-party applications. You can also choose to share some of your activity on Mahjool on certain social media networks which are connected to your Mahjool account. You can modify your settings and revoke your permission by visiting your account page.

Mahjool may receive or obtain information (for example: an email address or IP address) about a person who is not yet a registered Mahjool member (a "Non-Member") in connection with certain features of the Site or the Apps, such as when a member subscribes to an Mahjool newsletter, a member invites a non-member to visit the Site, a member uploads non-member information using the contact uploader feature, a non-member engages in a transaction, or a member sends a gift card code to a non-member. Non-member information is used only for the purposes disclosed when it was submitted to Mahjool. A non-member can contact Mahjool Support if they do not want Mahjool to retain their information.

Mahjool also collects certain information from both members and non-members who visit websites hosted by the Site. This information may include your IP address or unique device identifier, and cookies and data from the pages you visit. For more information on our use of cookies and collection of tracking information, see our Cookies & Tracking Technologies page or “Information Uses, Sharing & Disclosure” section below.

Choice & Control

We know that members of our community value having control over their own information, and therefore Mahjool gives you the choice of providing, editing or removing certain information, as well as choice over how we contact you.

You may change or correct your account information (except your username) on the Site. You may also remove certain optional information on the Site that you no longer wish to be publicly visible on the Site, such as your full name.

For various reasons, Mahjool may send you messages about our services or your activity. Some of these messages are required, service-related messages for members (such as transactional messages or legal notices). Other messages are not required, (such as newsletters), and you can control which optional messages you choose to receive by changing your settings in your account. Learn more in the “Messages from Mahjool” section of this policy.

If you have chosen to connect your account to an external, third-party application, such as Facebook, Gmail, or Linkedin you can change your settings and remove permission for the app by changing your account settings.

If you no longer wish to use the Site, the Apps, or other Mahjool services or receive service-related messages, then you may close your account by contacting Mahjool Support

Findability

Top

You may connect directly with your email service provider, your mobile device’s address book, or a social network account to import your contacts to Mahjool. We do not retain the login information for your email service, mobile device, or social network site. You may be able to search for people you know by email address or phone number on the Site or by connecting to your mobile device’s contact list through the Apps. Finding your friends on Mahjool helps you connect with them on our platform. For example, you can follow another member’s public activity, such as public Favorites. When you begin following another member’s activity, they will receive an email notification (unless a member has opted-out of receiving this type of email).

If you do not want your contacts to be able to find you on Mahjool through your email address, phone number, or social networking connections, then you may opt out through your account settings on the Site. If you do not wish to be located on Mahjool via your full name, you may remove your name from your public account information on the Site. It is not possible to opt out of being found via your username.

Messages from Mahjool

Top

On occasion, Mahjool will contact you. Primarily, these messages are delivered by email or by push notifications, and every account is required to keep a valid email address on file to receive messages. Mahjool may contact you by telephone to provide member support or for transaction related purposes if you give us permission to call you. Additionally, Mahjool may send you an SMS message or physical mail in order to provide you with customer support or to provide you with information about products and features you may find of interest. If you chose not to receive Mahjool communication please contact info@mahjool.com.

Some messages from Mahjool are service-related and required for members. Examples of service-related messages include an email address confirmation/welcome email when you register your account, notification of an order, and correspondence with Mahjool’s support team. You may not opt out of receiving service-related messages from Mahjool, unless you close your account.

Primarily, members will receive these messages via email or push notifications through the Apps, but you may choose to opt out of receiving different types of messages by contacting info@mahjool.com.

Mahjool offers optional email newsletters. When you register for an account, or choose to subscribe to a newsletter, you will receive newsletters from us. Newsletters are available to both members and non-members. Members may subscribe or unsubscribe from optional newsletters under account settings or by following the instructions contained in the newsletter emails. Non-members may subscribe by providing an email address, which will only be used by Mahjool for these newsletters. Non-members may unsubscribe from newsletters by following the instructions contained in the newsletter emails.

A contact-importer feature is available to help you locate and connect with your friends and contacts who may be members of Mahjool (see Findability). If someone in your contact list is not already a member, you may invite them to join Mahjool and an email will be sent to them on your behalf. Recipients of email invitations may opt out of receiving future invitations by following instructions in the email invitation message. You may only send an invitation to someone who has given you consent to receive one.

Community

Mahjool is both a marketplace and a community. We offer several features that allow members to connect and communicate in public or semi-public spaces, such as Blogs, Forums and Teams. Please use common sense and good judgment when posting in these community spaces or sharing your personal information with others on the Site and through the Apps. Be aware that any personal information you submit there can be read, collected, or used by others, or could be used to send you unsolicited messages. Mahjool generally does not remove content from community spaces, and your posts may remain public after your account is closed. You are responsible for the personal information you choose to post in community spaces on the Site and through the Apps.

Another Mahjool member may follow your public activity on the Site to receive updates, such as when you add an item to your public Favorites. You may choose to make certain activities private through your account settings on the Site. After a member has begun following your activity, you have the option to block that member through the Site if you do not wish to share your updates with that specific person.

Information Uses, Sharing & Disclosure

We respect your privacy. Mahjool will not disclose your name, email address or other personal information to third parties without your consent, except as specified in this policy. We generally use the information to provide and improve our services and products, for billing and payments, for identification and authentication, for targeted online and offline marketing, to contact members or interested parties, and for general research and aggregate reporting.

Mahjool limits access to your personal information by Mahjool personnel to those whom we believe reasonably need that information to provide products or services to you or in order to do their jobs.

If you reside outside of North America your information is still controlled by Mahjool LLC. Regardless of what country you reside in or supply information from, you authorize Mahjool to use your information in the United States and other country where Mahjool operates. Please be aware that the privacy laws and standards in certain jurisdictions may differ from those applying in the country in which you reside.

As part of the buying and selling process, Mahjool will facilitate the sharing of information between the two members involved in the transaction, such as the other member's email address, shipping address, and payment information. By making a sale or a purchase on the Site or through the Apps you are directing us to share your information in this way. We expect you to respect the privacy of the member whose information you received. As described in Mahjool's Terms of Use, you have a limited license to use that information only for Mahjool or or related communications or for Mahjool facilitated transactions. Mahjool has not granted you a license to use the information for unsolicited commercial messages or unauthorized transactions. Without express consent from that person, you must not add any Mahjool or Mahjool Consulting member to your email or physical mailing list or misuse any member’s personal information. Remember that you need to comply with all relevant legal rules when you use the Site or the Apps. This includes applicable data protection and privacy laws which govern the ways in which you can use another Mahjool or Mahjool Studio member’s information.

Mahjool may release your personal information to a third party in the following circumstances: to protect, establish, or exercise our legal rights or defend against legal claims; to comply with a subpoena, court order, legal process, or other legal requirement; or when we believe in good faith that such disclosure is necessary to comply with the law, prevent imminent physical harm or financial loss, or investigate, prevent, or take action regarding illegal activities, suspected fraud, threats to our property, or violations of Mahjool's Terms of Use.

Please review our Requests for Information Policy to learn more about how Mahjool responds to requests for records or information about members of Mahjool’s community. We also may disclose personal information to parties in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity in accordance with our Intellectual Property Policy. In such events, Mahjool may disclose a name, address, country, phone number, email address and company name.

Mahjool is affiliated with a variety of businesses and works closely with them. These businesses may offer promotions (including email promotions) or sell items or services to you through Mahjool’s services. Mahjool may also provide services or sell products jointly with affiliated businesses. When an affiliated business is associated with your transaction, we may share information related to the transaction with that affiliated business to facilitate your transaction.

Mahjool may share demographic information with business partners, but it will always be aggregated and anonymized, so personally-identifiable information is not revealed.

Mahjool may engage third party companies and individuals (such as payment processors, research companies, analytics and security providers) to help provide our services. These third parties have limited access to your information only to perform these tasks on our behalf and are obligated to Mahjool not to disclose or use your information for other purposes.

In some cases, Mahjool may choose to buy or sell assets. In these types of transactions (such as a sale, merger, liquidation, receivership or transfer of all or substantially all of Mahjool’s assets), member information is typically one of the business assets that is transferred. If Mahjool intends to transfer information about you, Mahjool will notify you by email or by putting a prominent notice on the Site and the App, and you will be afforded an opportunity to opt out before information about you becomes subject to a different privacy policy.

Third-party plug-ins also may collect information about your use of the Site. For example, when you load a page on the Site that has a social plug-in from a third-party site or service, such as a “Like” or “Send” button, you are also loading content from that third-party site. That site may request cookies directly from your browser. These interactions are subject to the privacy policy of the third-party site. In addition, certain cookies and other tracking mechanisms on our site are used by third parties for targeted online marketing and other purposes. These technologies allow a partner to recognize your computer or mobile device each time you visit the Site or use the Apps, but do not allow access to personal information from Mahjool. We can only speak for ourselves; this policy does not apply to the practices of third parties that Mahjool does not own or control, or individuals that Mahjool does not employ or manage. If you provide your information to others, different practices may apply to the use or disclosure of the information you provide to them. Mahjool does not control the privacy policies of third parties, including other Mahjool or Mahjool Studio members. Mahjool is not responsible for the privacy or security practices of Mahjool or Mahjool Studio members or other websites on the Internet, even those linked to or from the Site or Apps. We encourage you to ask questions before you disclose your personal information to others.

The security of your personal information is important to us. Your Mahjool account information is protected by a password. It is important that you protect against unauthorized access to your account and information by choosing your password carefully, and keeping your password and computer secure, such as by signing out after using our services.

Mahjool encrypts sensitive information (such as credit card numbers) using secure socket layer technology (SSL). Mahjool follows generally accepted industry standards to protect the personal information submitted to us, both during transmission and once Mahjool receives it. Unfortunately, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to protect your personal information, we cannot guarantee its absolute security.

Data Retention

Mahjool will retain your information only for as long as is necessary for the purposes set out in this policy, for as long as your account is active, or as needed to provide you services. If you no longer want Mahjool to use your information to provide you services, you may close your account. Please note that closing your account may not free up your email address, username, or shop name for reuse on a new account.

Mahjool provides a venue for buyers to find, learn about, and enter into transactions with sellers around the world. It is important to note, however, that Mahjool is not a part of that transaction. By shopping on Mahjool, you understand that:

  1. You are not buying directly from Mahjool, but from one of the many talented sellers on Mahjool;
  2. Mahjool does not pre-screen sellers and therefore does not guarantee or endorse any items sold on Mahjool or any content posted by sellers (such as photographs or language used in listings or shop policies); and
  3. Each seller on Mahjool accepts different payment methods and has their own processing times, shipping methods, and shop policies.

As a member of the community, you have the opportunity to flag an item or a shop that violates any of Mahjool’s policies. Flagging is confidential.

Communicating with Other Mahjool Members

Conversations

You can use Mahjool’s Conversations tool to communicate directly with sellers. Chats are a great way to ask sellers any questions you have about an item or an order. Chats may not be used for the following activities:

  1. Sending unsolicited advertising or promotions, requests for donations, or spam;
  2. Harassing or abusing another member;
  3. Contacting someone after they have explicitly asked you not to; or
  4. Interfering with a transaction or the business of another member.
Interference

Interference occurs when a member intentionally interferes with another member’s shop in order to drive away their business. Interference is strictly prohibited on Mahjool. Examples of interference include:

  1. Contacting another member via Mahjool Conversations to warn them away from a particular member, shop, or item;
  2. Posting in public areas to demonstrate or discuss a dispute with another member; or
  3. Purchasing from a seller for the sole purpose of leaving a negative review.
Harassment

Any use of Mahjool Chats to harass other members, to support or glorify hatred toward, or otherwise demean people based upon: race, ethnicity, religion, gender, gender identity, disability, or sexual orientation is strictly prohibited. If you receive a message that violates this policy, please let us know right away.

Purchasing an Item on Mahjool

When you buy from a Business Entity on Mahjool, you’re directly supporting an independent business, each with its unique listings, policies, processing times, and payment systems. By making a purchase from a seller on Mahjool, you agree that you:

  1. Have read the item description and shop policies before making a purchase;
  2. Have submitted appropriate payment for item(s) purchased; and
  3. Have provided accurate shipping information to the seller.

Leaving a Review of an Item

Reviews are a great way to learn about a seller’s items and reputation, help good sellers build a strong reputation, or help warn other buyers about a poor experience.

You can leave a review, including a one to five star rating and a photograph of your purchase, for 60 days after your item’s expected delivery date. The estimated delivery date is the purchase date + processing time + shipping time. You can edit your review, including the photograph, any number of times during that 60-day period.

By leaving a review or photograph, you acknowledge that:

  1. Your review and/or photograph and profile information will be publicly displayed on the seller's listing and review pages.
  2. Reviews and photographs may not:
    1. Contain private information;
    2. Contain obscene, racist, or harassing language or imagery;
    3. Contain medical drug claims;
    4. Contain advertising or spam;
    5. Be about things outside the seller’s control, such as a shipping carrier, Mahjool or a third party; or
    6. Undermine the integrity of the Reviews system.
  3. Extortion is not allowed on Mahjool. Any attempt to manipulate reviews through threats, intimidation, or bribery is considered extortion and is strictly prohibited on Mahjool. Examples of extortion include the following:
    1. A buyer leaves a negative review in an attempt to force the seller into providing additional items that were not agreed upon in the original transaction.
    2. A buyer leaves a negative review in an attempt to force the seller into providing a refund when a refund is not warranted.
  4. Shilling is not allowed on Mahjool. Shilling is the fraudulent inflation of a shop’s reputation by use of an alternate account. The intent of shilling is to make a seller look more desirable by increasing the shop’s number of sales and overall review score. Not only does it violate our core value of transparency, but it is considered to be a deceptive business practice by the US Federal Trade Commission. Reviews must reflect the honest, unbiased opinions, findings, beliefs, or experience of the buyer.

By uploading a photograph to Mahjool’s website you warrant that:

  1. You own the photograph or you have the rights or permission to use the photograph; and
  2. You understand that, as stated in Mahjool’s Terms of Use, Mahjool has license to use any content you provide to Mahjool.

Sellers may respond to reviews of three or fewer stars. Sellers’ responses to reviews must also comply with this policy. Sellers may hide photographs that they do not feel accurately represent their brand, or they may report reviews that violate our Terms of Use.

We reserve the right to remove reviews or photographs that violate our policies or Terms of Use.

Mahjool’s Case System

Although Mahjool is not directly involved in a transaction between a buyer and a seller, we provide a case system in the unlikely event your purchase from a seller does not go as expected. You can use Mahjool’s case system to come to a resolution with the seller in the event of a non-delivery, or if an item you receive is not as described in the listing. You can file a case under the following circumstances:

Non-Delivery

A Non-Delivery occurs when a buyer places an order and submits payment, but the seller does not ship the item or does not ship the item to the correct address. The following are examples of Non-Delivery cases:

  1. An item was never sent.
  2. An item was sent to an address that is not on the Mahjool receipt or was not verified through Mahjool Conversations or USPS address verification.
  3. There is no proof that the item was shipped to the buyer’s address.
Not-as-Described

An item is Not as Described if it is materially different from the seller’s listing description or photos. Here are a few examples of Not as Described cases:

  1. The item received is a different color, model, version, or size.
  2. The item has a different design or material.
  3. The seller failed to disclose the fact that an item is damaged or is missing parts.
  4. A buyer purchased three items but only received two.
  5. The condition of the item is misrepresented. For example, the description at the time of purchase said the item was “new” and the item is used.

Not as Described cases can also be filed for late delivery. In order to qualify as late delivery, the buyer must provide proof that all of these conditions have been met:

  1. The item(s) were ordered for a specific date or event.
  2. A deadline was agreed upon by the buyer and seller.
  3. The item(s) are rendered useless after that date.
Ineligible Transactions

The following are not eligible for Mahjool’s case system:

  1. Items that have been purchased in person
  2. Intangible items, services, or prohibited items
  3. Transactions where payment is not made through Mahjool’s Direct Checkout payment platform
  4. Items that are returned without a return agreement
  5. Items that have been altered, used, worn, or washed after receiving them
  6. Physical or tangible items that are not available for return because they have been destroyed or discarded by the buyer
  7. Items that are received after the agreed-upon delivery date due to shipping delays
  8. Cancelled transactions that have already resulted in a refund

Only sellers may cancel transactions. Buyers may request that a seller cancel an order via Mahjool Conversations.

Each seller has his or her own return policies, which should be outlined in their Shop Policies. Not all sellers accept returns.

Mahjool is a unique marketplace. Buyers come to Mahjool to purchase items that they customize themselves and might not find anywhere else. Items sold on Mahjool must be unique, creative and customizable.

Unique items are items which have a measure of individuality and distinctiveness. They must not be a copy of a pre-existing object or device.

Creative items are items which are a little tangential to the standard products in the market.

Customizable items are items which have the potential to be customized and be adaptable to different aesthetics, while keeping the function of the product the same.

What Can't be Sold on Mahjool

Top

Even if they otherwise meet our unique, creative and customizable criteria, prohibited items, services, and items that violate our intellectual property policies are not allowed to be sold on Mahjool.

Reselling is not allowed on Mahjool. Reselling refers to selling an item bought on Mahjool which was entirely created by a business entity with no input from you. In short, you may not resell items that you were not involved in designing or making.

If you are raising money on behalf of a charity, you must obtain that charity’s consent. Please see this Help article for more information about donating any portion of your sales to charity.

Representing Yourself, Your Shop, and Your Listings Honestly

One of Mahjool’s core values is transparency. Transparency means that you honestly and accurately represent yourself, your items, and your business.

By selling on Mahjool, you agree that you will:

  1. Provide honest, accurate information in your profile page, should you choose to complete it.
  2. Honor your Shop Policies, should you choose to publish them.
  3. Accurately represent your items in listings and listing photos.
  4. Respect the intellectual property of others. If you feel someone has violated your intellectual property rights, you can report it to Mahjool.
  5. Not engage in fee avoidance.
  6. Not create duplicate shops. Please see our Multiple Shops Policy for more details.

Communicating with Other Mahjool Members

Without the buyer’s explicit consent, you may not add any Mahjool member to your email or physical mailing list or store or misuse any payment information. Building a Positive Reputation Through our Reviews System

Providing Great Customer Service

We expect our sellers to provide a high level of customer service. By selling on Mahjool, you agree to:

  1. Honor your shipping and processing times. Sellers are obligated to ship an item or otherwise complete a transaction with a buyer in a prompt manner, unless there is an exceptional circumstance. Please be aware that legal requirements for shipping times vary by country. These requirements are detailed in our Shipping Policy.
  2. Respond to Conversations in a timely manner.
  3. Honor the commitments you make in your shop policies.
  4. Resolve disagreements or disputes directly with the buyer. In the unlikely event that you can’t reach a resolution, our Trust and Safety team can help through our case system.
  5. If you are unable to complete an order, you must notify the buyer and cancel the order.

Responding to Requests for Cancellations, Returns, and Exchanges

Please be aware that in addition to this policy, each country has its own laws surrounding shipping, cancellations, returns, and exchanges. Please familiarize yourself with the laws of your own country and those of your buyers’ countries.

Cancellations

If you are unable to complete a transaction, you must notify the buyer via Mahjool chat and cancel the transaction. If the buyer already submitted payment, you must issue a full refund. You are encouraged to keep proof of any refunds in the event a dispute arises.

You may cancel a transaction under the following circumstances:

  1. The buyer did not pay. (The seller may flag a buyer for a payment not received, chargeback, or canceled payment.)
  2. Both you and the buyer agree to cancel the transaction prior to shipment, and you have issued the buyer a full refund.
  3. You have decided to refuse service to the buyer, and if the buyer has already paid, you have issued a full refund, including shipping.
  4. The buyer did not receive the item(s) ordered, even though you provided proof of shipping, and you have issued a refund for the item. (Refunding shipping is optional, unless the buyer paid with Direct Payments, in which case you'll need to refund in full.)
  5. Both you and the buyer agreed that the buyer could return the item for a refund, you have received the returned item and issued a refund to the buyer for the item. (Refunding shipping is optional, unless the buyer paid with Direct Payments, in which case you will need to refund in full.)

Mahjool’s Case System

We ask buyers to contact a seller directly and attempt to resolve any outstanding issues before opening a case on Mahjool. For this reason, it is important that you fill out your shop policies and regularly respond to messages from your buyers.

Buyers may file a case for a non-delivery or a not-as-described item. You must respond to any open cases within seven days.

  3. Ship items promptly after they are sold. Prompt shipping means that you ship each item within 15 days of purchase, unless you specify otherwise in your processing time or agree to a different shipping period with the buyer through conversations.
  4. Comply with all local shipping regulations.
  5. Shipping to the wrong address is likely to result in a non-delivery case, so make sure to ship to the address listed on the Mahjool receipt (or verified by the USPS for US addresses) or sent to you by the buyer through an Mahjool Conversation.
  6. Mark the order as shipped when you ship it, or use a Mahjool Shipping Label, which automatically marks your order as shipped. Remember that you may only mark an order as shipped after you actually have shipped it. When you mark an order as shipped, the buyer will receive a Mahjool Shipping Notification via email.
  7. Charge an appropriate amount for shipping. US sellers can use calculated shipping to have shipping costs calculated automatically.

By entering tracking information on Mahjool, you're giving us permission to collect and share the tracking information received from your chosen shipping carrier with the buyer.

In the unlikely event an order does not arrive, be prepared to provide valid proof of shipping. Valid proof of shipping must show that the item actually was shipped and that it was sent to the address provided by the buyer (or verified via USPS address verification). If a buyer does not receive their order, they may file a case against your shop.

1. Mahjool Shipping Labels

Sellers in the United States and Canada who accept Direct Checkout or PayPal as a payment method are able to use Mahjool Shipping Labels.

By using Mahjool Shipping Labels, you confirm that:

  1. All shipping labels will only be used to ship corresponding Mahjool orders.
  2. Shipping labels may not be transferred or sold to a third party.
  3. Each shop has a designated bill limit for creating shipping labels, which is based on recent bill history. If you reach your bill limit, you must pay your bill before you can create another label. Read more about our bills in our Fees & Payments Policy.
  4. Mahjool reserves the right to remove your access to Mahjool Shipping Labels at any time and for any reason.

2. Shipping Insurance

You can purchase parcel insurance to protect your shipments. Insurance is available through Shipsurance for USPS and FedEx shipping labels.

Shipsurance Insurance

You may purchase parcel insurance from Shipsurance Insurance Services, Inc. for packages that are shipped using USPS or FedEx shipping labels. If you choose to purchase insurance from Shipsurance, you agree to the Shipsurance Coverage Rules.

Notices of Intellectual Property Infringement

Mahjool strives to respond quickly when we receive proper notice of intellectual property infringement by removing or disabling access to the allegedly infringing material. When Mahjool removes or disables access in response to a notice, Mahjool makes a reasonable attempt to contact the allegedly infringing party, provide information about the notice and removal, and, in cases of alleged copyright infringement, provide information about counter notification. Mahjool may also provide a copy of the notice to the allegedly infringing party.

Counter Notification

If Mahjool receives a DMCA counter notification, the removed material may be replaced or access to it may be restored 10 business days after receipt of the counter notice, unless the copyright owner files an action seeking a court order against the allegedly infringing party and informs Mahjool of this action. Mahjool sends a copy of the counter notice to the original complaining party.

Repeat Infringement

Mahjool terminates account privileges of members that are subject to repeat notices of intellectual property infringement in appropriate circumstances and at Mahjool’s discretion.

This policy is a part of our Terms of Use. The Terms are a legally binding contract between you and Mahjool LLC but we’ll just refer to Mahjool LLC. as "Mahjool".

Mahjool Member Records and Information

Before you contact Mahjool for records or information, first see if the information you are seeking is publicly available or request the records directly from the relevant Mahjool member.

Some information about Mahjool and Mahjool Consulting members (which we collectively refer to in this policy as "Mahjool Members") and Mahjool Shops (which we collectively refer to as "Shops"), such as a Shop’s name, the public name of its owner, and the Shop’s policies, is public and can be viewed by anyone at any time. In addition, Mahjool members may have access to certain records by logging in to their accounts. For example, Mahjool sellers can access and download sales records in .csv format, and all members can view their Conversation history by navigating to the relevant pages in their Mahjool accounts.

Mahjool Requires Valid Legal Process

Except in emergency situations or when consistent with our Terms of Use, Privacy Policy, and applicable law, Mahjool requires valid and sufficient legal process (such as a subpoena or court order, for example) to compel us to disclose records or information about an Mahjool member. Legal process must contain enough identifying information so that Mahjool can identify the member’s account. A common name, for example, does not uniquely identify a member’s account. Your legal process should include information such as an email address, transaction ID, username, shop name, or payment information.

Serving Mahjool with Legal Process to Request Access to Member Information

Before obtaining legal process, and contacting Mahjool, please check the location of the member whose information you are seeking. Requests for information relating to Mahjool members in the United States should be directed to info@mahjool.com. All requests for member information must be made with valid and sufficient legal process. Receipt of legal process by these means is for Mahjool’s convenience only and does not waive any objections, including lack of jurisdiction, subpoena power, or improper service.

Emergency Circumstances

If your request for information involves an emergency involving a danger of death or serious physical injury to a member of the Mahjool community or any member of the public, please contact your local law enforcement. If you are a law enforcement officer seeking information relating to such an emergency, please email info@mahjool.com from your official email address and provide the following:

  1. Your name and title, the government agency you work for, and your full contact information (government email address, phone number, and fax number);
  2. A summary of the facts about the emergency situation, including how the situation poses a danger of death or serious physical injury to an Mahjool member or any person;
  3. The identity of the person or people who are in danger;
  4. The specific records sought and how they relate to the emergency; and
  5. Why legal process cannot be obtained and the records must be disclosed without delay.

Notice to the Member Whose Records Are Sought

When Mahjool receives legal process seeking records or information about an Mahjool member, Mahjool may provide notice to that member, including a copy of the legal process. Mahjool may also allow the member enough time to appear and object to the legal process in court, if necessary.

Requests for Witness Testimony

Mahjool does not provide expert witnesses for trial or deposition. When Mahjool produces records, we provide a standard records custodian declaration of authenticity. A live testimony by a records custodian is unnecessary because the records are self-authenticating.

Cost Reimbursement

Mahjool may seek reimbursement for our costs directly incurred in searching for, assembling, collecting, and preparing records or information for production.

Cookies & Tracking Technologies

We use a variety of technologies to help us better understand how you use Mahjool.com (we refer to Mahjool.com as the "Site"), Mahjool's mobile applications (the "Apps") and our services (we refer to the Site, the Apps and our services collectively as "Mahjool"). Mahjool adheres to the Digital Advertising Alliance's Self-Regulatory Principles for Online Behavioral Advertising. As part of our commitment to upholding a high standard of transparency in our Privacy Policy and practices, we've created this guide to explain the tracking technologies we use on the Site.

Types of tracking technologies

There are three common types of tracking technologies used on Mahjool:

  1. Cookies: This is a small data file sent from a server to your web browser or mobile device that is stored in your browser cache or mobile device. You can configure your browser's settings to reflect your preference to accept or reject cookies (see Managing Cookies below).
  2. Clear gifs, web beacons, web bugs: These are tiny graphics with a unique identifier similar in function to cookies, and are used to track the online movements of web users. In contrast to cookies, which are stored on a user's computer hard drive, clear gifs are embedded invisibly on web pages and are about the size of the period at the end of this sentence. We do not tie the information gathered by clear gifs to your personally identifiable information.
  3. Flash cookies, local shared objects (LSOs): Flash cookies are used to collect and store information, but differ from browser cookies in the amount, type and manner in which data is stored. Mahjool uses Flash cookies in order to facilitate services such as fraud prevention. Mahjool does not tie the information gathered by Flash cookies to your personally identifiable information. To learn how to manage privacy and storage settings for Flash cookies click here. Tracking technologies have two different lifespans:
    1. Persistent means it remembers certain information about your preferences for viewing the site, and allows Mahjool to recognize you each time you return. Persistent cookies are stored on your browser cache or mobile device until you choose to delete them.
    2. Session, on the other hand, is specific to a particular visit to the site, to carry information as you view different pages on Mahjool so you don’t have to re-enter information. Session cookies expire and delete themselves automatically when you leave the Site or close your web browser.

These technologies allow a partner to recognize your computer or mobile device each time you visit Mahjool, but do not allow access to personally identifiable information from Mahjool.
