Mahjool's Services connect people around the world, both online and offline, to make, sell and buy unique goods. Here’s a handy guide to help you understand the specific rules that are relevant for you, depending on how you use the Services:
All of these policies are a part of our Terms, so be sure to read the ones that are relevant for you. Of course, you'll still want to read the rest of this document because it applies to everyone!
You’ll need to create an account with Mahjool to use some of our Services. Here are a few rules about accounts with Mahjool:
This detailed Help article should answer any questions you have about registering an account with Mahjool.
Content that you post using our Services is your content (so let’s refer to it as “Your Content”). We don’t make any claim to it. That includes anything you post using our Services (like usernames, shop names, profile pictures, listing photos, listing descriptions, reviews, comments, videos, etc.).
That sounds like a lot, but it's necessary for us to keep Mahjool going. Consider these examples: if you upload a photo of a listing on your Mahjool shop, first, we have permission to display it to buyers, and second, we can resize it so it looks good to a buyer using our mobile app; if you post a description in English, we can translate it into French so a buyer in Paris can learn the story behind your item; and if you post a beautiful photo of your latest handmade product, we can feature it on our homepage, in one of our blogs or even on a billboard to help promote your business and Mahjool's.
License to Use Our Services. We grant you a limited, non-exclusive, non-transferable and revocable license to use our Services—subject to the Terms and the following restrictions in particular:
If you or Mahjool terminate your account, you may lose any information associated with your account, including Your Content.
We do not guarantee that: (i) the Services will be secure or available at any particular time or location; (ii) any defects or errors will be corrected; (iii) the Services will be free of viruses or other harmful materials; or (iv) the results of using the Services will meet your expectations. You use the Services solely at your own risk. Some jurisdictions do not allow limitations on implied warranties, so the above limitations may not apply to you.
We hope this never happens, but if Mahjool gets sued because of something that you did, you agree to defend and indemnify us. That means you’ll defend Mahjool (including any of our employees) and hold us harmless from any legal claim or demand (including reasonable attorney’s fees) that arises from your actions, your use (or misuse) of our Services, your breach of the Terms or your account’s infringement of someone else’s rights.
We reserve the right to handle our legal defense however we see fit, even if you are indemnifying us, in which case you agree to cooperate with us so we can execute our strategy.
If you find yourself in a dispute with another user of Mahjool’s Services or a third party, we encourage you to contact the other party and try to resolve the dispute amicably.
For initiating a Case please contact email@example.com.
If you’re upset with us, let us know, and hopefully we can resolve your issue. But if we can’t, then these rules will govern any legal dispute involving our Services:
If you are a government agent or entity in the United States using the Services in your official capacity, and you are legally unable to agree to the clauses in this section, then those clauses do not apply to you. In that case, the Terms and any action related to the Terms will be governed by the laws of the United States (without reference to conflict of laws) and, in the absence of federal law and to the extent permitted under federal law, the laws of the State of Massachusetts.
We may update these Terms from time to time. If we believe that the changes are material, we’ll definitely let you know by doing one (or more) of the following: (1) posting the changes through the Services or (2) sending you an email or message about the changes. That way you can decide whether you want to continue using the Services. Changes will be effective upon the posting of the changes. You are responsible for reviewing and becoming familiar with any changes. Your use of the Services following the changes constitutes your acceptance of the updated Terms.
The Terms, including all of the policies that make up the Terms, supersede any other agreement between you and Mahjool regarding the Services. If any part of the Terms is found to be unenforceable, that part will be limited to the minimum extent necessary so that the Terms will otherwise remain in full force and effect. Our failure to enforce any part of the Terms is not a waiver of our right to later enforce that or any other part of the Terms. We may assign any of our rights and obligations under the Terms.
At Mahjool, we care deeply about privacy. We believe in transparency, and we’re committed to being upfront about our privacy practices, including how we treat your personal information. We know you care about your privacy too, so we provide settings that allow you to choose how certain information is used by Mahjool. This policy explains our privacy practices for Mahjool.com (we’ll refer to Mahjool.com as the "Site"), Mahjool’s mobile applications (the "Apps") and services provided by Mahjool, Inc ("Mahjool").
By using Mahjool, you authorize Mahjool to use your information in the United States and any other country where Mahjool operates. Please be aware that the privacy laws and standards in certain countries, including the rights of authorities to access your personal information, may differ from those applying in the country in which you reside. We will only transfer personal data to these countries where permitted to do so by law and we will take steps to ensure that your personal information continues to enjoy appropriate protections.

If you have provided your location details but would no longer like to share that information, you may opt out of those services through the settings on the Apps or on your mobile device. We will only share your geo-location details with third parties (like our mapping providers) for the sole purpose of providing you with those services. You may also enable the Apps to access your mobile device’s camera to upload photographs to Mahjool.
Some members or visitors may connect to the Site or the Apps or register an account using an external third-party application, such as Facebook, Gmail or LinkedIn. Mahjool may receive data from those connected third-party applications. Mahjool may receive or obtain information (for example: an email address or IP address) about a person who is not yet a registered Mahjool member (a "Non-Member") in connection with certain features of the Site or the Apps, such as when a member subscribes to an Mahjool newsletter, a member invites a non-member to visit the Site, a member uploads non-member information using the contact uploader feature, a non-member engages in a transaction, or a member sends a gift card code to a non-member. Non-member information is used only for the purposes disclosed when it was submitted to Mahjool. A non-member can contact Mahjool Support if they do not want Mahjool to retain their information.
We know that members of our community value having control over their own information, and therefore Mahjool gives you the choice of providing, editing or removing certain information, as well as choice over how we contact you.
You may change or correct your account information (except your username) on the Site. You may also remove certain optional information on the Site that you no longer wish to be publicly visible on the Site, such as your full name.
For various reasons, Mahjool may send you messages about our services or your activity. Other messages are not required, (such as newsletters), and you can control which optional messages you choose to receive by changing your settings in your account. Mahjool may contact you by telephone to provide member support or for transaction related purposes if you give us permission to call you. Additionally, Mahjool may send you an SMS message or physical mail in order to provide you with customer support or to provide you with information about products and features you may find of interest. If you chose not to receive Mahjool communication please contact firstname.lastname@example.org.

Non-members may unsubscribe from newsletters by following the instructions contained in the newsletter emails.
A contact-importer feature is available to help you locate and connect with your friends and contacts who may be members of Mahjool (see Findability). If someone in your contact list is not already a member, you may invite them to join Mahjool and an email will be sent to them on your behalf. Recipients of email invitations may opt out of receiving future invitations by following instructions in the email invitation message. You may only send an invitation to someone who has given you consent to receive one.
Mahjool is both a marketplace and a community. We offer several features that allow members to connect and communicate in public or semi-public spaces, such as Blogs, Forums and Teams. Please use common sense and good judgment when posting in these community spaces or sharing your personal information with others on the Site and through the Apps. Be aware that any personal information you submit there can be read, collected, or used by others, or could be used to send you unsolicited messages. Mahjool generally does not remove content from community spaces, and your posts may remain public after your account is closed. You are responsible for the personal information you choose to post in community spaces on the Site and through the Apps.
Another Mahjool member may follow your public activity on the Site to receive updates, such as when you add an item to your public Favorites. You may choose to make certain activities private through your account settings on the Site. After a member has begun following your activity, you have the option to block that member through the Site if you do not wish to share your updates with that specific person.
We respect your privacy. Mahjool will not disclose your name, email address or other personal information to third parties without your consent, except as specified in this policy. We generally use the information to provide and improve our services and products, for billing and payments, for identification and authentication, for targeted online and offline marketing, to contact members or interested parties, and for general research and aggregate reporting.

In such events, Mahjool may disclose a name, address, country, phone number, email address and company name.
Mahjool is affiliated with a variety of businesses and works closely with them. These businesses may offer promotions
(including email promotions) or sell items or services to you through Mahjool’s services. Mahjool may also provide

Mahjool may share demographic information with business partners, but it will always be aggregated and anonymized, so personally-identifiable information is not revealed.
Mahjool may engage third party companies and individuals (such as payment processors, research companies, analytics and security providers) to help provide our services. These third parties have limited access to your information only to perform these tasks on our behalf and are obligated to Mahjool not to disclose or use your information for other purposes.
We can only speak for ourselves; this policy does not apply to the practices of third parties that Mahjool does not own or control, or individuals that Mahjool does not employ or manage. If you provide your information to others, different practices may apply to the use or disclosure of the information you provide to them. Mahjool follows generally accepted industry standards to protect the personal information submitted to us, both during transmission and once Mahjool receives it. Unfortunately, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to protect your personal information, we cannot guarantee its absolute security.
Mahjool will retain your information only for as long as is necessary for the purposes set out in this policy, for as long as your account is active, or as needed to provide you services. If you no longer want Mahjool to use your information to provide you services, you may close your account. Please note that closing your account may not free up your email address, username, or shop name for reuse on a new account.
You may inform us of any changes or requests regarding your personal data by contacting firstname.lastname@example.org, and in accordance with our obligations under applicable data protection law, we may update or delete your personal data accordingly. We may update this policy from time to time. If we believe that the changes are material, we’ll definitely let you know by doing one (or more) of the following: (1) posting the changes on the Site and Apps, (2) sending you an email or message about the changes, or (3) posting an update in the version notes on the Apps’ platform. That way you can decide whether you want to continue using the Site or Apps. Changes will be effective upon the posting of the changes. You are responsible for reviewing and becoming familiar with any changes. Your use of the Site or App following the changes constitutes your acceptance of the updated policy.

You can use Mahjool’s Conversations tool to communicate directly with sellers. Chats are a great way to ask sellers any questions you have about an item or an order. Chats may not be used for the following activities:
Interference occurs when a member intentionally interferes with another member’s shop in order to drive away their business. Interference is strictly prohibited on Mahjool. Examples of interference include:
Any use of Mahjool Chats to harass other members, to support or glorify hatred toward, or otherwise demean people based upon: race, ethnicity, religion, gender, gender identity, disability, or sexual orientation is strictly prohibited. Reviews are a great way to learn about a seller’s items and reputation, help good sellers build a strong reputation, or help warn other buyers about a poor experience.
You can leave a review, including a one to five star rating and a photograph of your purchase, for 60 days after your item’s expected delivery date. The estimated delivery date is the purchase date + processing time + shipping time. You can edit your review, including the photograph, any number of times during that 60-day period.
By leaving a review or photograph, you acknowledge that:
By uploading a photograph to Mahjool’s website you warrant that:
Although Mahjool is not directly involved in a transaction between a buyer and a seller, we provide a case system in the unlikely event your purchase from a seller does not go as expected. You can use Mahjool’s case system to come to a resolution with the seller in the event of a non-delivery, or if an item you receive is not as described in the listing. You can file a case under the following circumstances:Non-Delivery
A Non-Delivery occurs when a buyer places an order and submits payment, but the seller does not ship the item or does not ship the item to the correct address. The following are examples of Non-Delivery cases:
An item is Not as Described if it is materially different from the seller’s listing description or photos. Here are a few examples of Not as Described cases:
Not as Described cases can also be filed for late delivery. In order to qualify as late delivery, the buyer must provide proof that all of these conditions have been met:
The following are not eligible for Mahjool’s case system:
Only sellers may cancel transactions. Buyers may request that a seller cancel an order via Mahjool Conversations.Returning an Item

Mahjool’s Case System
Mahjool is a unique marketplace. Buyers come to Mahjool to purchase items that they customize themselves and might not find anywhere else. Items sold on Mahjool must be unique, creative and customizable.
Unique items are items which have a measure of individuality and distinctiveness. They must not be a copy of a pre-existing object or device.
Creative items are items which are a little tangential to the standard products in the market.
Customizable items are items which have the potential to be customized and be adaptable to different aesthetics, while keeping the function of the product the same.
Even if they otherwise meet our unique, creative and customizable criteria, prohibited items, services, and items that violate our intellectual property policies are not allowed to be sold on Mahjool.
Reselling is not allowed on Mahjool. Reselling refers to selling an item bought on Mahjool which was entirely created by a business entity with no input from you. In short, you may not resell items that you were not involved in designing or making.
If you are raising money on behalf of a charity, you must obtain that charity’s consent. Please see this Help article for more information about donating any portion of your sales to charity.
One of Mahjool’s core values is transparency. Transparency means that you
honestly and accurately represent yourself, your items, and your business.
By selling on Mahjool, you agree that you will:

The estimated delivery date is the purchase date + processing time + shipping time. Buyers can edit their review, including the photograph, any number of times during that 60-day period.
On the rare occasion you receive an unfavorable review, you can reach out to the buyer.
Reviews and your response to reviews may not:
Extortion is not allowed on Mahjool. Any attempt to manipulate reviews through threats, intimidation, or bribery is considered extortion and is strictly prohibited on Mahjool. Extortion includes when a seller offers a buyer additional goods, services, or compensation in exchange for a positive review.Shilling
Shilling is strictly prohibited on Mahjool. Shilling is the fraudulent inflation of a shop’s reputation by use of an alternate account. The intent of shilling is to make a seller look more desirable by increasing the shop’s number of sales and overall review score. Not only does it violate our core value of transparency, but it is considered to be a deceptive business practice by the US Federal Trade Commission. Reviews must reflect the honest, unbiased opinions, findings, beliefs, or experience of the buyer.
We expect our sellers to provide a high level of customer service. By selling on Mahjool, you agree to:
Mahjool will help you provide great customer service and maintain trust with your buyers through

Please be aware that in addition to this policy, each country has its own laws surrounding shipping, cancellations, returns, and exchanges. Please familiarize yourself with the laws of your own country and those of your buyers’ countries.
If you are unable to complete a transaction, you must notify the buyer via Mahjool chat
and cancel the transaction. If the buyer already submitted payment, you must issue a full refund.
You are encouraged to keep proof of any refunds in the event a dispute arises.
You may cancel a transaction under the following circumstances:
We ask buyers to contact a seller directly and attempt to resolve any outstanding issues before opening a case on Mahjool. For this reason, it is important that you fill out your shop policies and regularly respond to messages from your buyers.
Buyers may file a case for a non-delivery or a not-as-described item. You must respond to any open cases within seven days.

Not as Described cases can also be filed for late delivery. In order to qualify as late delivery, the buyer must provide proof that all of these conditions have been met:
For more information on how to resolve a case, please contact email@example.com.
Sellers are responsible for shipping their sold items to buyers. If you're using a shipping or fulfillment service, please keep in mind that you are ultimately responsible for making sure that your buyers receive the item(s) they purchased from your shop.
By selling on Mahjool, you agree to:
By entering tracking information on Mahjool, you're giving us permission to collect and share the tracking information received from your chosen shipping carrier with the buyer.
In the unlikely event an order does not arrive, be prepared to provide valid proof of shipping. Valid proof of shipping must show that the item actually was shipped and that it was sent to the address provided by the buyer (or verified via USPS address verification). If a buyer does not receive their order, they may file a case against your shop.
Sellers in the United States and Canada who accept Direct Checkout or PayPal as a payment method are able to use Mahjool Shipping Labels.
By using Mahjool Shipping Labels, you confirm that:
You can purchase parcel insurance to protect your shipments. Insurance is available through Shipsurance for USPS and FedEx shipping labels.
You may purchase parcel insurance from Shipsurance Insurance Services, Inc. for packages that are shipped using USPS or FedEx shipping labels. If you choose to purchase insurance from Shipsurance, you agree to the Shipsurance Coverage Rules.
As a venue for artists, designers, and makers, Mahjool takes intellectual
property rights very seriously. We comply with intellectual property laws and
industry best practices in order to maintain the integrity of our creative
marketplace. This Intellectual Property Policy explains how we address
allegations of infringement, how authorized parties can submit proper notices
of infringement regarding content on our marketplace, and how Mahjool
sellers can respond when their listings or shops are affected by a notice.
If you would like to submit a notification of alleged infringement, counter a notice of copyright infringement submitted against you, or withdraw a notification of infringement that you submitted, please contact firstname.lastname@example.org.
Mahjool strives to respond quickly when we receive proper notice of intellectual property infringement by removing or disabling access to the allegedly infringing material. When Mahjool removes or disables access in response to a notice, Mahjool makes a reasonable attempt to contact the allegedly infringing party, provide information about the notice and removal, and, in cases of alleged copyright infringement, provide information about counter notification. Mahjool may also provide a copy of the notice to the allegedly infringing party.
If Mahjool receives a DMCA counter notification, the removed material may be replaced or access to it may be restored 10 business days after receipt of the counter notice, unless the copyright owner files an action seeking a court order against the allegedly infringing party and informs Mahjool of this action. Mahjool sends a copy of the counter notice to the original complaining party.
Mahjool terminates account privileges of members that are subject to repeat notices of
intellectual property infringement in appropriate circumstances and at Mahjool’s discretion.
Please contact email@example.com to provide notice of claimed infringement to Mahjool’s designated agent.
Mahjool aims to be transparent and mindful as we re-imagine commerce to
build a more fulfilling and lasting world. In that spirit of transparency, this
policy explains how we respond to requests for records or information about
members of Mahjool’s community.
Before you contact Mahjool for records or information, first see if the information you are seeking is publicly available or request the records directly from the relevant Mahjool member.
Some information about Mahjool and Mahjool Consulting members (which we collectively refer to in this policy as "Mahjool Members") and Mahjool Shops (which we collectively refer to as "Shops"), such as a Shop’s name, the public name of its owner, and the Shop’s policies, is public and can be viewed by anyone at any time. In addition, Mahjool members may have access to certain records by logging in to their accounts. For example, Mahjool sellers can access and download sales records in .csv format, and all members can view their Conversation history by navigating to the relevant pages in their Mahjool accounts.
Before obtaining legal process, and contacting Mahjool, please check the location of the member whose information you are seeking. Requests for information relating to Mahjool members in the United States should be directed to firstname.lastname@example.org. All requests for member information must be made with valid and sufficient legal process. Receipt of legal process by these means is for Mahjool’s convenience only and does not waive any objections, including lack of jurisdiction, subpoena power, or improper service.
If your request for information involves an emergency involving a danger of death or serious physical injury to a member of the Mahjool community or any member of the public, please contact your local law enforcement. If you are a law enforcement officer seeking information relating to such an emergency, please email email@example.com from your official email address and provide the following:
When Mahjool receives legal process seeking records or information about an Mahjool member, Mahjool may provide notice to that member, including a copy of the legal process. Mahjool may also allow the member enough time to appear and object to the legal process in court, if necessary.
Mahjool does not provide expert witnesses for trial or deposition. When Mahjool produces records, we provide a standard records custodian declaration of authenticity. A live testimony by a records custodian is unnecessary because the records are self-authenticating.
Mahjool may seek reimbursement for our costs directly incurred in searching for, assembling, collecting, and preparing records or information for production.
